Two Types of Child Custody

There are two types of child custody, legal custody and physical custody. Legal custody grants the right to make decisions related to your child’s health care, education, religion, and other major decisions. Most couples have joint legal custody, meaning both parents can make those decisions. In certain cases, such as when a parent is found to be abusive, neglectful, abuses drugs, or is in prison, the court can put an end to legal custody for that parent. Then, sole legal custody is given to the other parent.

Physical custody refers to the parent or guardian with whom the child lives as well as visitation rights. Most of the time, the court assigns one parent as the primary physical custodian and the other parent is appointed as the secondary physical custodian. It is also becoming more common for the courts and/or the parents (in a collaborative divorce) to decide that custody is split evenly between parents.

In addition to the physical custody covering where the child lives, it also determines how child support is computed. The primary physical custodian usually has a higher child support ratio because the child is with that parent more of the time.
